These Terms of Service govern access to and use of Tracost, including our web, iOS, Android, backend, notification, reporting, and related services.
Acceptance of Terms
By accessing or using Tracost, you agree to these Terms. If you use Tracost on behalf of an organization, you confirm that you are authorized to accept these Terms for that organization.
If you do not agree to these Terms, do not use Tracost.
About Tracost
Tracost is a construction cost tracking and team operations application. It helps organizations manage project sites, budgets, expenses, credit debts, transfers, reports, team messages, user roles, and operational notifications.
Accounts and Access
You may need an account to use Tracost. You are responsible for keeping your login credentials secure and for all activity under your account. You must provide accurate account information and promptly update it if it changes.
Organization administrators control user access, roles, assigned sites, and permissions for their organization. We may suspend or disable access if we reasonably believe an account has been compromised, violates these Terms, or creates risk for Tracost or other users.
Organization Data
Your organization is responsible for the accuracy, legality, and use of information entered into Tracost, including budgets, transactions, vendors, receipts, debts, transfers, team messages, and reports.
Tracost is a recordkeeping and workflow tool. It is not a substitute for professional accounting, tax, legal, construction, procurement, or financial advice.
Acceptable Use
You agree not to:
- Use Tracost for unlawful, fraudulent, harmful, or misleading activity.
- Access or attempt to access accounts, data, systems, or networks without authorization.
- Interfere with, disrupt, overload, reverse engineer, or abuse Tracost or its infrastructure.
- Upload malicious code or content that violates the rights, privacy, or safety of others.
- Use Tracost to send spam, abusive messages, or unauthorized email or SMS communications.
- Copy, resell, lease, sublicense, or commercially exploit Tracost except as expressly permitted by us.
Notifications and Communications
Tracost may send account, invitation, budget, expense, debt, email, and SMS notifications. Standard carrier charges may apply to SMS messages. Users can manage optional notification preferences where the product provides those controls.
Third-Party Services
Tracost may depend on third-party services for hosting, authentication, storage, email, SMS, analytics, payments, or other operations. Your use of those services may also be subject to their own terms and policies.
Fees and Payment
If Tracost offers paid plans, fees, billing cycles, taxes, refunds, and cancellation terms will be described in the applicable order, invoice, plan, or written agreement. You are responsible for fees and taxes associated with the plan or services you choose.
Intellectual Property
Tracost and its software, design, trademarks, logos, and related materials are owned by us or our licensors. These Terms do not transfer ownership of Tracost to you.
You retain ownership of the data and content you or your organization submit to Tracost. You grant us the rights needed to host, process, transmit, display, secure, back up, and otherwise operate Tracost for you.
Privacy
Our Privacy Policy explains how we collect, use, share, and protect information. You can review it at /privacy-policy.html.
Service Availability
We work to keep Tracost available and reliable, but we do not guarantee uninterrupted or error-free service. Tracost may be changed, suspended, limited, or discontinued for maintenance, security, business, legal, or operational reasons.
Termination
You may stop using Tracost at any time. We may suspend or terminate access if you violate these Terms, create risk, fail to pay applicable fees, or if required by law. Some provisions of these Terms will continue after termination, including payment obligations, ownership, disclaimers, limitations of liability, and dispute terms.
Disclaimers
Tracost is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, Tracost and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities.
Indemnity
You agree to defend, indemnify, and hold harmless Tracost and its owners, operators, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your use of Tracost, your organization data, or your violation of these Terms.
Governing Law
These Terms are governed by the laws of Ghana, unless applicable law requires otherwise. Courts located in Ghana will have jurisdiction over disputes, except where applicable law provides a different mandatory forum.
Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continued use of Tracost after changes become effective means you accept the updated Terms.
